Access to Documents
Legal basis
Access to documents is one of the core rules of the general principle of transparency and good governance (Article 15(3) of the Treaty on the Functioning of the European Union). According to this rule, the public is entitled to request access to all documents produced by EU institutions or bodies. The same right is recognized in Article 42 of the Charter of Fundamental Rights of the EU.
Regulation (EC) No 1049/2001 of the European Parliament and the Council of 30 May 2001 regarding public access to European Parliament, Council and Commission documents governs this fundamental right of access to documents.
Article 19 of the SESAR Joint Undertaking Statutes, annexed to Council Regulation (EC) No 219/2007 of 27 February 2007 on the establishment of a Joint Undertaking to develop the new generation European air traffic management system (SESAR) as amended by Council Regulation (EC) No 1361/2008 of 16 December 2008 and Council Regulation (EU) No 721/2014 of 16 June 2014 (hereafter referred to as “SJU Regulation”), requires the Joint Undertaking to adopt practical arrangements for implementing Regulation (EC) No 1049/2001.
These practical arrangements are governed by Decision ADB(D)-12-011 of the Administrative Board of the SESAR Joint Undertaking “Concerning the transparency and public access to the documents of the Joint Undertaking” and by further internal rules of the SJU.
Procedure
Requests for access to the SESAR Joint Undertaking documents may be submitted in any EU official language. However, in order to facilitate the processing of your request, you are kindly invited to submit your request in English.
